5. GOVERNING LAW

This website is controlled and operated by Eidos Interactive Ltd from its offices in London, England. Eidos Interactive Ltd excludes all representations and warranties that materials in and/or facilities or services offered through this website are available for use in other locations, or that they comply with any legal or regulatory requirements of such other locations. Those who choose to access this website do so at their own risk and on their own initiative and are responsible for compliance with applicable local laws.

These terms shall be governed by and construed in accordance with English law. Any dispute under these terms shall be subject to the exclusive jurisdiction of the English courts and, by using this website, you hereby submit to the non-exclusive jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts.

6. MISCELLANEOUS

If any court of competent jurisdiction finds any provision of these terms to be void or unenforceable for any reason then such provision shall be ineffective to the extent of the court's finding without affecting the validity and enforceability of any remaining provisions.

Ordering and Payment
Ordering Merchandise

Eidos Montréal offers for purchase at the Eidos Montréal Store site various items (e.g., apparel, books, posters, etc.) ("Merchandise"). All offers to purchase Merchandise via the Eidos Montréal Store are made and accepted subject to these terms and conditions (the "Purchase Terms"). Your communications with Eidos Montréal or submission of any purchase order or other similar forms containing provisions contrary to the terms of these Purchase Terms are hereby rejected and are not binding on Eidos Montréal.

You must place orders at the Eidos Montréal Store using Visa, MasterCard, American Express, Interac, or Internet Secure. You must be 18 years of age or older and a United States resident and have a valid credit card. If you are under the age of 18, you must have permission from your parent or legal guardian to order. When you provide credit card information to Eidos Montréal, you represent to Eidos Montréal that you are the authorized user of the credit card that is used to pay for Merchandise and authorize Eidos Montréal to charge your credit card for any Merchandise fees incurred by you.

Pricing and Payment

In addition to the above, the following terms apply to pricing of and payment for Merchandise. The prices for Merchandise displayed at the Eidos Montréal Store are subject to change at any time without notice. Charges for shipping, handling and tax may not be included in displayed prices for Merchandise but will be displayed during the purchase process. Shipping and handling charges displayed at the Eidos Montréal Store may or may not reflect the actual charges paid by Eidos Montréal. All war-risk, marine, or other insurance; harbor charges; tolls; wharfage; demurrage; wharf handling; duties, or warehousing charges are excluded from Merchandise prices displayed at the Eidos Montréal Store and are your responsibility.

You must pay all applicable sales and use taxes, value added taxes and other taxes levied on you by any taxing authority on any Merchandise purchase, regardless of the method of delivery. Any taxes owed by you that are: (i) a result of purchasing Merchandise or the payment of any fee, (ii) required or permitted to be collected from you by Eidos Montréal under applicable law, and (iii) based upon the amounts payable under this Agreement, must be remitted by you to Eidos Montréal. Failure on Eidos Montréal's part to invoice you for any such taxes does not relieve you of the liability to pay such taxes. You will promptly reimburse Eidos Montréal for all taxes or other charges imposed upon Eidos Montréal by any national, state or municipal government upon the sale, use, production, or transportation of Merchandise.

Notifications

Upon submission of your order:

  1. You will be sent an email confirmation about your order. This email will provide you with the items ordered and your total order cost, including tax and shipping fees.
     
  2. When your order ships, we will send you another email to notify you that we shipped your order. This email will include shipping method and tracking number (if applicable).
     
  3. Should there be any deficiencies with your order that prevent Eidos Montréal from processing it, you will be notified by email with the specifics of the problem, and any actions required to process your order.
     
  4. Orders are usually processed within 2-3 business days of placing the order. Additional credit card or address verification may delay order processing.

Delivery / Acceptance

Delivery

This is a shipment agreement. All Merchandise will be shipped from Montreal, Quebec, Canada, unless Eidos Montréal designates otherwise on the Eidos Montréal Store in connection with a particular order. Eidos Montréal's liability as to delivery ceases, and title and risk of loss for the Merchandise will pass upon Eidos Montréal's delivery of the Merchandise to a transportation carrier at the designated shipping point. If you pick up the Merchandise from Eidos Montréal's place of business, title to and risk of loss will pass to you when Merchandise is placed at your disposal.

Eidos Montréal does not accept orders to ship to a P.O. Box.

Evaluation and Acceptance.

You will have a period of thirty (30) days after the date of receipt of any Merchandise to examine the Merchandise to confirm that it conforms to these Purchase Terms and the offer for such Merchandise presented to you at the Eidos Montréal Store. If the Merchandise does not conform to these Purchase Terms and the offer for such Merchandise presented to you at the Eidos Montréal Store, you may reject the Merchandise by returning it to Eidos Montréal (at your expense) along with a copy of the receipt or other proof of purchase. After Eidos Montréal has received your valid return, Eidos Montréal will, within a reasonable time and in Eidos Montréal's sole discretion: repair the Merchandise, replace the Merchandise with an equivalent item, credit to the credit card used to pay for the product an amount equal to the value of the Merchandise (as determined by Eidos Montréal in its reasonable discretion), or provide another remedy that Eidos Montréal determines in good faith is appropriate in the circumstances. All claims whether based on contract, negligence, strict liability or otherwise are waived unless made in writing and received by Eidos Montréal within thirty (30) days after your receipt of Merchandise. All returns require a Return Merchandise Authorization (RMA) from Eidos Montréal's Customer Service Department.YOU ACKNOWLEDGE AND AGREE THAT WITH REGARD TO ANY MERCHANDISE YOU PURCHASE VIA THE EIDOS MONTRÉAL STORE, AS YOUR EXCLUSIVE REMEDY (IN ADDITION TO THE REMEDIES EXPRESSLY SET FORTH IN THE PRECEDING PARAGRAPH), EIDOS MONTRÉAL MAY INCLUDE, IN ITS OPTION, THE RIGHT TO PAY TO YOU THE AMOUNT OF DIRECT DAMAGES ACTUALLY INCURRED BY YOU IN REASONABLE RELIANCE ON SUCH MERCHANDISE, AS LONG AS THAT AMOUNT DOES NOT EXCEED THE AMOUNT YOU PAID EIDOS MONTRÉAL FOR THE MERCHANDISE GIVING RISE TO THOSE DAMAGES.

  1. Delivery of Merchandise generally takes 1-2 weeks. Please consider, however, the following factors that will affect when your order will be shipped or received.Product availability (out of stock or future ship item).

    • Product availability (out of stock or future ship item).
    • Delivery destination.
       
  2. Shipments and deliveries are made during business days only (no weekend delivery). Weekends should not be included in calculating arrival time.  
     
  3. If you ordered multiple items, we retain the option to hold your shipment until all items are in stock.  
     
  4. Eidos Montréal reserves the option to select the best shipping carrier based on delivery destination. Shipping costs will be adjusted as appropriate. You will be notified of any such changes and have the option to change or cancel your order prior to shipping.  
     
  5. Undeliverable Packages

Our carriers may deem a package undeliverable for one of the following reasons: Incorrect Address.

  1. If the address is incorrect, incomplete, or outdated, the carrier or the unintended recipient typically returns the package to us. Please double-check your address carefully when placing a new order.
     
  2. Failed Delivery Attempts. Most of our carriers make three attempts to deliver a package. If no one is present to accept the delivery after three attempts, the package will either be returned to us (Domestic Address) or destroyed by the shipper.
     
  3. Refused by Recipient. If you are sending your order as a gift and the recipient is not expecting it, they may refuse the package if they believe it was sent to them in error. Also, if other people live at your address, you may want to let them know that a package is arriving so a roommate or family member does not refuse it.

In the event a package is returned to us your account will be credited, minus any tax and shipping charges.
